ORDER

This petition is filed to call for the records pertaining to the case pending trial in CC.No.5 of 2010 on the file of the learned Judicial Magistrate Ambattur and quash the same.

2. It is brought to my notice by both the counsels that the trial has commenced and the case is under argument stage. Though the petitioner has raised various grounds challenging the proceedings before the trial Court, I am of the view that it would not be appropriate to interfere with the proceedings at this stage. This Court is also conscious of the fact that any finding that may be given with regard to the grounds raised by the petitioner will have a bearing on the proceedings and this Court consciously refrains from making such observations. It is made clear that it is open to the petitioner to raise all these grounds before the trial Court.
