Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, praying for the issue of a Writ of Certioraried Mandamus, calling for the entire records connected with the impugned Charge Memo dated 27.03.2013 served on 27.03.2013 by the second respondent in Memo No.JES/JSC/001/2013 without complying with the Mandate contained in Sub Section (1) of Section 18 and Section 19 of the Tamil Nadu Private Colleges Regulation Act 1976 and the Rule 12 of the Tamilnadu Private Colleges (Regulation) Rules 1976 and quash the same as ultra vires of the said Act and its Rules.

The learned counsel appearing for the Writ petitioner states that the Charge Memo issued to the writ petitioner in proceedings dated 27.03.2013 is under challenge in this writ petition.

2.However, during the pendency of the writ petition, the writ petitioner was reinstated in service and now working. During the pendency of this writ petition the Enquiry Proceedings were concluded and the respondents have not passed any final order, on account of the pendency of the present writ petition. In view of the fact that the Enquiry Proceedings were completed the respondents are at liberty to take a final decision in the Disciplinary Proceedings and pass orders on merits and in accordance with law.

3. Accordingly, the writ petition stands closed. However, there is no order as to costs. Consequently, the connected Miscellaneous Petitions are closed.
