Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents herein to fix the special grade elementary school Headmaster pay of the petitioner at Rs.8000-13500 instead of 6500-10,500/- as per G.O.Ms.No.207, Education Department dated 30.09.2008 so as to enable the petitioner to get revised pension within a time to be stipulated by this Court.

O R D E R

The writ petition has been filed by the petitioner seeking for Mandamus directing the respondents herein to fix the Special Grade Elementary School Headmaster pay of the petitioner at Rs.8000-13500 instead of Rs.6500-10,500/- as per G.O.Ms.No.207, Education Department, dated 30.09.2008, so as to enable the petitioner to get revised pension within a time prescribed by this Court.

2. The learned counsel for petitioner submitted that the petitioner has made a representation on 02.02.2012 to the https://hcservices.ecourts.gov.in/hcservices/

respondents seeking to disburse the arrears consequent to the implementation of G.O.Ms.No.207 in his favour. However, till date, no action was taken on such representation. The petitioner has sought for the relief fixed for Special Grade Elementary School Headmaster to pay of the petitioner at Rs.8000-13500/- instead of Rs.6,500-10,500/- as per G.O.Ms.No.207, Education Department, dated 30.09.2008, till date, no action was taken.

3. Heard the submissions of M/s.S.Mani, learned counsel appearing for the petitioner and Mr.A.Rajaperumal, learned Additional Government Pleader appearing for the respondents.

This Court, without going into the merits of the case, directs the petitioner to give fresh representation to the first respondent within a period of 15 days from the date of receipt of a copy of this order and on receipt of such representation, the first respondent is directed to consider the said representation, in the light of G.O.Ms.No.207, Education Department, dated 30.09.2008 and pass orders, on merits and in accordance with law, within a period of eight weeks thereafter.

5. With the above direction, this writ petition is disposed of accordingly. No costs.
