This petition is filed under Section 378 (4) Cr.P.C, to grant leave for preferring the accompanying appeal to set aside the order of acquittal of judgment dated 10.03.2023 the learned Metropolitan Magistrate FTCII, Allikulam Complex, Egmore, Chennai in C.C.No.4206/2016 convict the respondent.
2. Heard Mr.D.Padmanabhan, learned counsel for the petitioner.
3. Learned counsel for the petitioner contended that the complaint was filed under Section 138 of the Negotiable Instruments Act against the respondent/accused and the same was dismissed by the trial Court for non appearance of the present complainant on a single hearing date. According to him, there are arguable points in the main appeal and therefore, leave is granted as prayed for.
