ORDER

The petitioners apprehend arrest for the alleged offence under Sections 191(2), 191(3), 126(2), 103(1) of BNS Act in Crime No.159 of 2026 on the file of the respondent police seeks anticipatory bail.

2. The case of the prosecution is that due to previous enmity between A1 and the son of the defacto complainant, both groups met near a petrol bunk and attacked each other, in which the son of the defacto complainant sustained injuries. Hence the case.

3. The learned counsel for the petitioners submitted that the petitioners are innocent and they have not committed any offence as alleged by the prosecution and they have been falsely implicated in this case. He further submitted that they are ready to abide by any conditions that may be imposed by this Court and ready to co-operate with the investigation. Hence, he prayed to grant anticipatory bail to the petitioners.

4.The learned Government Advocate (Crl.Side) would strongly oppose the application on the ground that the investigation is still pending. Hence, he opposed to grant anticipatory bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. This Court is of the view that this is a case involving murder. Though the learned counsel for the petitioner would vehemently contend that the petitioner is innocent, the investigation is still in progress. Considering the stage

of investigation, this Court is of the view that it is premature to consider the bail application. If any order is granted at this stage, it would seriously jeopardize the prosecution case.
