ORDER

The petitioner, who apprehends arrest for the alleged offence under Sections 4(1)(C) and 4(1-A) of TNP (Amendment) Act r/w 24 of TNP Act in Crime No.13 of 2026, on the file of the respondent police seeks anticipatory bail.

2.The case of the prosecution is that on 27.01.2026 at about 3.00 p.m., while the police were on rounds near Alasanthapuram Bus Stand, they noticed the petitioner/A2 travelling on a TVS XL Heavy Duty motorcycle bearing Registration No. TN 83 B 5847. On seeing the police, the petitioner allegedly attempted to flee, while A1 was apprehended at the spot. The police allegedly seized 144 bottles of Old Chef Strong XXX Rum and 48 bottles of Mans Club Deluxe Brandy, each containing 180 ml, from the possession of the petitioner. Hence, the case.

3.Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person, he has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He further submitted that the petitioner is a law-abiding citizen and he is ready and willing to furnish substantial sureties and to abide by any conditions that may be imposed by this Court; therefore, he prayed to grant anticipatory bail to the petitioner.

4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and, would strongly oppose the grant of anticipatory bail to the petitioner on the sole ground that the

petitioner has got 27 previous cases Hence, he strongly opposed to grant anticipatory bail to the petitioner.

5.Heard both sides and perused the materials available on record. 6.Considering the rival submissions and the nature of the offence and the fact that the petitioner has been implicated based on the confession also considering that the petitioner has 27 previous cases which are of similar in nature, in all the cases, he has been released on bail and also considering the coaccused has also been released on bail, I am inclined to grant anticipatory bail to the petitioner, subject to certain conditions.

Accordingly, the petitioner is ordered to be released on bail in the event of his arrest, on his executing a bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) with two sureties, each for a like sum to the satisfaction of the Judicial Magistrate Court, Vaniyambaid at Thirupathur, and on further conditions that:- [a] the petitioner shall report before the Inspector of Police, Vaniyambadi Police Station everyday at 10.30 a.m., for a period of thirty days (30) and thereafter as and when required for interrogation.

[b] the petitioner shall not commit any offences of similar nature. [c] the petitioner shall not abscond either during investigation or trial. [d] the petitioner shall not tamper with evidence or witness either during investigation or trial.

[e] On breach of any of the aforesaid conditions, the learned Judicial Magistrate/Trial Court is entitled to take appropriate action against the petitioner in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560].

[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 BNS.
