Respondents PRAYER: Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus, to call for the records of the 2nd respondent in particularly Clause 48 of the prospectus issued for admission to Post Graduate Degree/Diploma/6 year Mch (Neuro Surgery) courses in Tamil Nadu Government Medical Colleges/Self Financing Institutions of the year 2014-15 is concerned and the consequential notification dated Nil issued by the 2nd respondent in the website issued for Post Graduate Degree/Diploma/Mch (Neuro Surgery) 6 years/ MDS courses for IInd Phase tentative counselling schedule 2014-15 in so far as the last column in so far as the candidates who are taken allotment during the 1st Phase of counseling but not joined/discontinued the course will not be permitted is concerned and quash the same and consequently direct the 2nd respondent to permit the petitioner to attend the IInd Phase of counseling to be held from 30.
4.2014 to 03.5.2014 and the IIIrd Phase of counseling and issue allotment order in accordance with Service Schedule caste category.

O R D E R The challenge made in the writ petition is Clause 48 of the prospectus issued for admission to Post Graduate Degree/Diploma/6 year Mch (Neuro Surgery) courses in Tamil Nadu Government Medical Colleges/Self Financing Institutions of the year 2014-15 is concerned and the consequential notification dated Nil issued by the 2nd respondent in the website issued for Post Graduate Degree/Diploma/Mch (Neuro Surgery) 6 years/ MDS courses for IInd Phase tentative counseling schedule 2014-15 in so far as the last column in so far as the candidates who are taken allotment during the 1st Phase of counseling but not joined/discontinued the course will not be permitted is concerned and quash the same and consequently direct the 2nd respondent to permit the petitioner to attend the IInd Phase of counseling to be held from 30.4.2014 to 03.5.2014 and the IIIrd Phase of counseling and issue allotment order in accordance with Service Schedule caste category.
2.In view of the fact that the cause aroused for filing of the writ petition did not exists as of now. Thus, no further adjudication is required. Accordingly, the writ petition stands disposed of as infructuous. No costs. Consequently, connected miscellaneous petition is closed.
