The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 341, 294(b), 506(ii) & 307 of IPC in Crime No.287 of 2023 on the file of the respondent police, seeks anticipatory bail.
2. The case of the prosecution is that due to previous enmity, the petitioner, along with other accused, waylaid the defacto complainant and attacked him with knife and thereby caused injuries to him. Hence the complaint.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and a false case has been foisted on account of previous enmity. He further submitted that the petitioner is ready to abide by any stringent conditions as may be imposed by this Court. Hence he prayed to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Crl. Side) opposed for grant of anticipatory bail to the petitioner stating that due to previous enmity, the petitioner, along with other accused, waylaid the defacto
complainant and attacked him with knife and thereby caused injuries to him. He further submitted that the injured has been discharged from the hospital. He also submitted that there are two previous cases pending against the petitioner.
5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) and perused the materials available on record including the FIR.
6.Taking note of the facts and circumstances of the case and the submissions made by the learned counsel on either side and also taking note of the fact that there are two previous cases pending against the petitioner, hence, this Court is not inclined to grant anticipatory bail to the petitioner.
7. Accordingly, the Criminal Original Petition stands dismissed.
