This Criminal Original Petition has been filed by the petitioner/ A3, who was arrested and remanded to judicial custody on 16.05.2024, seeking bail in Crime No.92 of 2024 registered for the offence under Sections 294(b), 302, 342 and 307 of IPC.

2. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and she has been falsely implicated in this case. He also submitted that the petitioner is no way connected with the alleged offence and she was not present at the scene of occurrence. He further submitted that the petitioner, who is aged about 59 years, is suffering incarceration from 16.05.2024 and she is ready to abide by any stringent conditions that may be imposed by this court and hence, he prayed to grant bail to the petitioner.

Learned Government Advocate (Criminal Side) appearing for the respondent police objected for granting bail stating that due to the existing civil dispute, the first and second accused, who are respectively the son and grandson of the petitioner herein, had abused the de facto complainant and his father in filthy language and assaulted them with knife, due to which, the de facto complainant sustained grievous injuries and his father died without responding to the treatment. 4. He further submitted that the specific allegation against the petitioner herein/A3 is that she had instigated A1 and A2 to commit murder of the de facto complainant and his father and also gave knife to them. He further submitted that the the investigation in this case is at initial stage.

5. Taking into consideration the facts and circumstances of this case and the submissions made by the learned counsel on either side and taking note of the fact that the investigation is at initial stage, this Court is not inclined to grant bail to the petitioner.
