This Criminal Original Petition has been filed by the petitioner, who was arrested and remanded to judicial custody on 25.05.2024, seeking bail in Crime No.137 of 2024, registered under Section 174 Cr.P.C & 304 of IPC @ for the offences under Sections 8(c) r/w 21(a), 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985.

2. Learned counsel appearing for the petitioner submitted that this is the second application for bail filed by the petitioner before this Court and the earlier bail application filed by the petitioner in Crl.O.P.No.14014 of 2024 was dismissed by this Court on 14.06.2024. He further submitted that the petitioner has nothing to do with the alleged offence and she has been suffering incarceration from 25.05.2024 along with her one year old child. Hence, he sought for bail.

Learned Government Advocate (Crl.Side) appearing for the respondent police raised objection stating that, it is the case, where the son of the de facto complainant died since he injected the tydol tablets mixed with glucose. Further, the petitioner herein, who had been involved in selling Tydol Tablets to the youngsters for intoxication, had sold the Tydol tablets to the victim/deceased, aged about 17 years and his friend. He further submitted that the earlier bail application of the petitioner was dismissed on 14.06.2024 and there is no change in circumstances. https://www.mhc.tn.gov.in/judis

Taking into consideration the facts and circumstances of the case, submissions made by the learned Government Advocate (Crl.Side) that there is no change in circumstances and also considering that the investigation is not yet completed, this Court is not inclined to grant bail to the petitioner.
