ORDER
This Writ Petition has been filed by the petitioner seeking to quash the order dated 11.10.2017 made in I.D.No.128 of 2002 on the file of the Presiding Officer, III Additional Labour Court, Chennai.
2. The case of the petitioner is that, the second respondent was employed with the petitioner management. As against the oral termination, he raised an industrial dispute before the first respondent/Labour Court and the Labour Court passed an award for reinstatement with continuity of service, full backwages and other attendant benefits in favour of the second respondent. Challenging the same, the above writ petition is filed before this Court.
3. When the matter is taken up for hearing today, the learned counsel appearing for the petitioner management submitted that, during the pendency of this writ petition, there was an amicable settlement between the petitioner management and the second respondent/workman and the petitioner management agreed to pay a sum of Rs.4,00,000/- as compensation in full quit to the second respondent, within the time frame that may be stipulated by this Court. 2/4
4. The second respondent/workman along with his counsel appeared before this Court and agreed to receive the compensation as offered by the petitioner management.
5. In view of the above settlement arrived between the parties, this Court modifies the impugned award passed by the Labour Court as follows :- (i) the petitioner management is directed to pay a sum of Rs.4,00,000/- as compensation in full quit to the second respondent by way of Demand Draft, within a period of eight (8) weeks from the date of receipt of a copy of this order.
6. With the above modification, this Writ Petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed. 12.09.2023 Index : Yes (or) No Speaking Order : Yes (or) No sp To The Presiding Officer, III Additional Labour Court, Chennai.
