ORDER
This Writ Petition has been filed for the issue of Writ of Mandamus directing the 2nd respondent to consider the representation made by the petitioner on 27.2.2017, wherein, the petitioner is seeking for the cancellation of the registration of a decree made in doucment No.101/2017.
2. Heard Mr.V.Gunasekar, learned counsel for the petitioner and Mr.T.M.Pappiah, learned Special Govt. Pleader appearing for the respondents 1 to 3.
3. It is seen from the records that the 2nd respondent had already entertained the complaint made by the petitioner and had also called the parties for an enquiry. The grievance of the https://hcservices.ecourts.gov.in/hcservices/
petitioner is that the 2nd respondent thereafter did not proceed further with the enquiry and pass orders. Left with no other alternative , the present writ petition has been filed before this Court.
4.Taking into consideration the facts and circumstances of the case and the limited relief sought for in this Writ Petition, without going into the merits of the case, there shall be a direction to the 2nd respondent to conduct an enquiry on the complaint given by the petitioner on 27.2.2017 by giving an opportunity to the petitioner and the 4th respondent and final orders shall be passed strictly in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
The petitioner is directed to make a fresh representation to the 2nd respondent along with all the relevant documents and also a copy of this order.
5. This Writ Petition is disposed of with the above directions. No costs.
