To direct the 1st Respondent Police to execute the Non Bailable Warrant issued on 26.05.2025 by the learned Train Court in S.T.C No.2618 of 2023 which is pending the file of FTC IV Metropolitan Magistrate George Town against the Respondent No.2 to 4.

ORDER
The petitioner, as complainant in STC.No.2618 of 2023, had filed this petition seeking a direction to the first respondent police to execute the NonBailable Warrant issued against the respondents 2 to 4 by the trial court in STC.No.2618 of 2023.
2. Learned Government Advocate (Criminal Side) had submitted a report which is as follows:
" Respectfully submitted that a warrant received by registered post from the IV Fast Track Court, George Town, Chennai, directing the execution of warrant against the following accused persons:
1. Mr.Renganathan Nishanth Sakthivel
2. Ms.Nadaraja Deepika at the address: M/s Trisul Steel and TMT Bars Pvt. Ltd., No.4/9, New Tech Silharam Apartment, Raman Street, T.Nagar, Chennai - 600 017.
In pursuance of the said warrant, the undersigned deputed Sub-Inspector of Police, Mr.Rajeshwaran and Constable No.57869 Mr.Khaja Moydeen to the above mentioned address for execution of the warrant.
Upon visiting the said premises, one of the building owners, Mr.Chandru Sethuram (Mobile: 9840081159), was contract, who informed that no such company by the name of M/s.Trisul Steel and TMT Bars Pvt. Ltd. exists at the said address. The watchman of the premises, Mr.Gajendran, was also questioned, but he too could not provide any information regarding the said company.
Subsequently, upon gathering information that the said company Trisul Steel and TMT Bars Pvt. Ltd. had previously operated from Nungambakkam, the officers proceeded to the address at G2, Ground Floor, Capital Towers, No.180, Kodambakkam High Road, Nungambakkam, Chennai - 600 034.
Upon arrival at the said premises, the company was found to be absent from that location as well. The premises is currently occupied by a firm named Konica Minolta. Enquires made with neighbouring occupants revealed that the said office had been operational until the year 2023, after which it was vacated. No information was available regarding the current whereabouts of:
1.Mr.Renganathan Nishanth Sakthivel
2. Ms.Nadaraja Deepika In view of the above facts and circumstances, it is humbly submitted that the execution of the warrant could not be carried out as the accused persons and the company are not
traceable at the known addresses. The warrant could not be executed, and the same is hereby respectfully reported to your Honour for further orders."

From the report, it is seen that the respondents 2 to 4 are not available in New Tech Silharam Apartment, Raman Street, T.Nagar, Chennai - 600 017 and Capital Towers, No.180, Kodambakkam High Road, Nungambakkam, Chennai - 600 034. In view of the same, Non-Bailable Warrant is unable to be executed.
4. The petitioner to find out the whereabouts of the respondents 2 to 4 and the details to be submitted before the trial court and the trial court thereafter shall issue Non-Bailable Warrant. Once the non-bailable warrant is issued, the jurisdictional police is directed to take effective steps to execute the nonbailable warrant.
5. In view of the above, this Criminal Original Petition is disposed of. Consequently, the connected miscellaneous petition is closed. 15-06-2026 nl Index: Yes/No Speaking/Non-speaking order
