CMP Nos.12714, 12715, 12718 & 12721 of 2020 in S.A.No.667 of 2011 CMP Nos.12714, 12715, 12718 & 12721 of 2020 in S.A.No.667 of 2011 P.T.ASHA, J The above applications have been filed (i) to set aside the abatement caused by the death of the first respondent (ii) to appoint 3rd respondent herein as guardian of minor 5th respondent (iii) to condone the delay of 253 days in seeking to set aside the abatement caused by the death of the deceased first respondent and (iv) to bring on record the respondents 3 to 5 herein as legal representatives of deceased first respondent and rank them as respondents 3 to 5 in the above second appeal.

2. The learned counsel for the respondents 1 and 2 has no objection to these applications being allowed.

3. Sufficient reasons have been given in the affidavit filed in support of the applications and accordingly, these applications are ordered.

4. Registry is directed to carry out necessary amendment and post the matter for arguments on 17.08.2021.
