Respondents PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, for issuance of Writ of Certiorarified Mandamus, to call for the records relating to the impugned order of the first respondent in A6/2533/2013 dated 06.12.2013 and quash the same and direct the first respondent to correctly enter the petitioner's date of registration as 12.02.2007 in all records relating to the petitioner's registration and sponsor the petitioner's name to the second respondent with the date of Page No.1/6

registration as 12-02-2007 and consequently direct the second respondent to appoint the petitioner as ECG Technician with effect from the date on which a candidate who registered after 12.02.2007 was appointed as ECG Technician with all consequential benefits.

ORDER

This is a classic example as to the entering of registration date wrongly done by the Office of Employment Exchange, eventually the petitioner is put to serious inconvenience. The petitioner who suffered by wrongly entering the registration date in the communications, by the 1st respondent namely, the District Employment Officer, Guindy, Chennai has moved this writ of certiorarified mandamus.

The petitioner passed SSLC, Higher Secondary Course, EEG and ECG examinations. His name was registered with the District Employment Office, (Technical) Chennai on 12.02.2007 under Registration No.E/318/2007, as per the Employment Exchange Registration Card furnished to him.

The petitioner further submits that while computerizing the data, it appears that his date of registration was wrongly entered as 12.12.2007 instead of 12.02.2007 under Registration No. CHT/2007/MOO000318. He had received an interview letter dated 30.03.2012 sent by the 1st respondent, for appointment to the post of ECG Technician. He attended the interview and produced all his certificates, but did not receive any appointment order.

At a later point of time, he found that persons who registered after 12.02.2007 were given appointment as ECG Technician, because of the wrong entry as mentioned above, he lost his employment opportunity. Upon his representation to the District Employment Officer (Technical) Chennai, he received a reply in A6/2533/2013 dated 06.12.2013 (the impugned order) that the registration date has been correctly entered in the computer. Hence, this writ petition.

Heard Mr.P.Rajendran, the learned counsel appearing for the petitioner and Mr.S.Rajesh, the learned Government Advocate appearing for the respondents.

A perusal of the Employment Exchange Registration Card, it appears that the petitioner registered his Education details on 12.02.2007 but in the Identity Card issued by the Department of Employment and Training, the date of registration is mentioned as 12.12.2007 instead of 12.02.2007. When this was pointed out by him by sending representation, the 1st respondent has sent a communication to the petitioner that the date of registration has been correctly entered in the computer. 7.

As rightly pointed out by the learned counsel for the petitioner that had date of the registration been correctly entered in the Identity Card as 12.02.2007 as found in the Employment Exchange Registration Card, the petitioner would have been employed as ECG Technician, if he is otherwise qualified. Therefore, it is necessary to issue a direction, to rectify the mistake pointed out by the petitioner. 8.

Based on the aforesaid discussions, this writ petition is allowed, quashing the order of the respondents in A4/2533/2013 dated 06.12.2013 with a direction to correctly enter the date of registration of the petitioner as 12.02.2007 in all records relating to the registration preferably within a period of 4 weeks from the date of receipt of a copy of this order. Consequently, the connected miscellaneous petitions, if any, shall stand closed. No costs.
