Crl.M.P.No.9163 of 2023 in Crl.R.C. No.811 of 2023 M.NIRMAL KUMAR, J.

This Court by its order dated 28.04.2023 had granted limited stay of the proceedings of the order dated 31.01.2023 in M.C.No.32 of 2019, for a period of six weeks, primarily on condition that the petitioner to deposit 50% of arrears of maintenance awarded by the trial court. Thereafter, the petitioner had preferred Crl.M.P.No.9163 of 2023 seeking extension of time and this Court by order dated 10.10.2023 granted two weeks time to the petitioner.

Today, the learned counsel for the petitioner submitted that the petitioner has not complied with the conditional order of this court dated 28.04.2023, despite giving extension of time on 10.10.2023.

In view of the same, the interim order passed by this court is vacated. The respondent as well as the court below shall proceed with the case in accordance with law, as regards the order passed in M.C.No.32 of 2019 dated 31.01.2023.

Post the matter on 21.11.2023.
