Crl.M.P.No.8498 of 2016 in Crl.R.C.No.1240 of 2009 G.CHOCKALINGAM, J This petition is filed to restore the above Crl.R.C.No.1240 of 2009, which was set aside by the order dated 30.06.2016. 2.When the matter is taken up for hearing, the learned counsel for the petitioner has requested this Court that the petition may be allowed with cost. He has also made an endorsement to that effect and the same reads as follows:

"This petition may be allowed on cost".

3.The learned counsel for the second respondent has no objection in allowing this petition.

4.Hence, this petition is allowed on condition that the petitioner shall pay the cost of Rs.500/- (Rupees Five Hundred only) to the respondent on or before 14.09.2016, failing which, the petition shall stand dismissed automatically without further reference to this Court.

Post the matter on 15.09.2016 07.09.2016.
