Writ petition has been filed seeking for issuance of mandamus forbearing the respondents from dispossessing the petitioner from his Patta Lands situate in S.F.Nos.43/1A, 43/1B, 43/1D and 42/1, Melanur Village, Harur Taluk, Dharmapuri District.
2. The learned counsel for the petitioner submitted that the order passed by the third respondent has not been communicated to the petitioner. Therefore, the learned counsel seeks for a direction to the respondents to communicate the said order to the petitioner so as to enable him to file appeal. for the petitioner also submitted that till such time, the respondent may be restrained from dispossessing the petitioner from the lands in question.
3. Heard the learned Additional Government Pleader on the submission made by the learned counsel for the petitioner.
4. Since it is submitted that the order passed by the third respondent has not been communicated to the petitioner, the respondents are directed to communicate the said order to the petitioner within a period of 15 days from the date of receipt of a copy of this order, if the same has not been communicated to him. If the respondents have already communicated the said order, they are directed to forward another copy enclosing the earlier date of despatch as well as date of receipt of the same by the petitioner.
5. It is made clear that if the petitioner has already received the said order, the period of limitation would start from the date of receipt of earlier order and not from the date of copy of the order to be communicated by the respondents based on the above orders of this Court.
The writ petition is disposed of accordingly. No costs. Connected miscellaneous petition is closed.
