O R D E R

This writ petition has been filed by the petitioner praying for the issuance of a Writ of Declaration, declaring the order of transfer dated 10.11.2003, transferring the petitioner herein from the factory at Re.Survey No.239/3, 239/4, 240/5 & 240/6, Kurumbakaram Nedungadu Commune, Karaikal - 609 603, to Goa and the consequent letter dated 20.02.2004 to be illegal and mala fide and amounting to unfair labour practice and unenforceable as against the petitioner and direct the respondent herein not to give effect to the said order of transfer in any manner whatsoever.

Mrs.G.Dhana Madhri, learned counsel appearing for the respondent Management submitted that the parties have settled the matter and a settlement also has been reached between the petitioner and the respondent on 08.07.2014. Pursuant thereto, the gratuity amount had been paid to the petitioner. The learned counsel appearing for the respondent Management has also placed on record the documents showing the settlement reached between the https://hcservices.ecourts.gov.in/hcservices/

petitioner and the respondent on 08.07.2014. The documents shows that the petitioner's resignation letter dated 04.07.2014 has been accepted and he has been relieved from service of the company with effect from 04.07.2014 and a receipt dated 21.07.2014 signed by the petitioner viz., S.Ravichandran also shows that he has received a sum of Rs.93,978/- towards full and final settlement of gratuity amount.

3. In view of the above, nothing survives in this writ petition and hence the same is dismissed. No costs. Consequently, the connected miscellaneous petition is also dismissed.
