Respondents Petition filed under Article 226 of the Constitution of India for the issuance of writ of Mandamus directing the respondents to pay pension to the petitioner and also the arrears of pension with interest at the rate of 9% with effect from 01.04.2009 and award costs.

Heard the learned counsel for the petitioner and the learned Standing Counsel for Transport Corporation on behalf of the respondents. By consent, the Writ Petition is taken up for disposal during the time of admission.

2. The petitioner was employed as a Driver in Tamil Nadu State Transport Corporation. The petitioner was dismissed from service alleging acts of misconduct. The petitioner raised a dispute in I.D.No.259/92. The Labour court passed an award in his favour. The petitioner was thereafter reinstated in service. attaining the age of superannuation retired on 31.03.2009. According to the petitioner, he served the required number of years for the purpose of payment of pension. However pension was not paid to him. The petitioner submitted a representation on 09.07.2013 requesting the first respondent to sanction him pension. The present request is to direct the first respondent to consider and dispose of the said representation on merits.

3. The first respondent is directed to consider and dispose of the representation submitted by the petitioner dated 09.07.2013 on merits and as per law. Such exercise shall be completed within a period of three months from the date of receipt of a copy of this order.
