This is the Second bail petition filed by the petitioner, who was arrested and remanded to judicial custody on 18.04.2022 for the offences punishable under Section 328 of IPC and Section 5(1) r/w 6 of POCSO Act in crime No.61 of 2021 on the file of the respondent police.

2. The case of the prosecution is that the petitioner gave a cool drink with anesthisia drug and had sexual intercourse with the daughter of the defacto complainant. Hence, the case.

3. Earlier, this Court dismissed the bail petition filed by the petitioner in Crl.O.P.No.15135 of 2022, on 01.07.2022, considering the fact that petitioner has committed very serious and heinous offence as against the minor victim girl.

4. Taking into consideration of the facts and circumstances of the case, and that there is no change in circumstances of this case, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
