O R D E R

This Writ Petition has been filed by the petitioner seeking for a direction to the respondents to fix the seniority on par with his Batchmates who were appointed as Sub-inspector of Police in the year 2008 pursuant to the selection of the year 2006-2007 based on the marks secured by the petitioner in the police training college as per Rule by considering the representation of the petitioner dated 06.02.2018 within a reasonable time.

2. Heard the learned counsel for the petitioner as well as learned Additional Government Pleader who accepts notice on behalf of the respondents.

3. The grievance of the petitioner in this Writ Petition is that though he was recruited in the year 2008, but his seniority was not fixed on par with his batchmates, in accordance with rule. He has submitted a representation in this regard on 06.02.2018, but no decision on the same is taken till date. Hence, the petitioner has come forward with this Writ Petition, https://hcservices.ecourts.gov.in/hcservices/

seeking for the aforesaid relief.

3. The learned counsel appearing for the petitioner submits that since the first respondent is guilty of the inaction, in the absence of the counter affidavit, a direction be given to the first respondent to dispose of the representation of the petitioner dated 06.02.2018, within a stipulated period, by taking informed and considered decision.

4. The learned Additional Government Pleader who accepts notice on behalf of the respondent submits that seniority of his batchmates is yet to be finalised and at the time of finalization of the seniority, his case shall also be taken into consideration.

5. Regard being had to the aforesaid facts and submissions made, this Writ Petition is disposed of, with a direction to the first respondent to take into consideration, the representation of the petitioner dated 06.02.2018 in accordance with law, while finalising the seniority list. However, it is made clear that this Court has expressed no opinion of the merits of the representation, in any manner. No costs.
