ORDER

This Criminal Original Petition has been filed seeking to direct the learned District and Sessions Court/Special Judge for S.C and S.T Act, Tiruvannamalai to consider their surrender and pass appropriate orders on the bail application filed by the petitioners on the same day in connection with Crime No.81 of 2026 on the file of Respondent Police.

2. Heard the learned counsel for the petitioners and the learned Additional Public Prosecutor for the respondents 1 and 2.

Considering the submissions made by the learned counsel on either side and upon perusal of the materials available on record, it is seen that, due to previous enmity, there was a wordy quarrel between the petitioners and the de facto complainant. During the quarrel, the petitioners assaulted the de facto complainant and the society workers with their hands, abused them in filthy language by mentioning their caste name, and also threatened them with dire consequence.

In view of the specific bar under Section 18 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and also taking into consideration the possibility of misusing the pious intention of the Parliament against innocent persons, there shall be a direction to the jurisdictional Court, to consider the petitioners' bail application, preferably on the same day of their surrender, in connection with Crime No.81 of 2026 on the file of the second respondent Police and to pass appropriate orders in accordance with law, after affording due opportunity to the victims under Section 15-A of the SC/ST (PoA) Act, 1989. The petitioners shall surrender before the jurisdictional Court within a period of fifteen days from the date of receipt of a copy of this order.
