ORDER

The petitioner, who was arrested and remanded to judicial custody on 23.09.2025 for the alleged offences under Sections 331(4), 305 of BNS, in Crime No.263 of 2025 on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner trespassed into the defacto complainant's shop and committed theft of Rs.6,65,500/- kept in the bag. Hence, the case.

The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case. He further submitted that the investigation in this case has almost been completed. He also submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

At this juncture, the learned Government Advocate (Criminal Side) strongly opposed the bail application on the ground that the petitioner has got 55 previous cases. He also submitted that this is the third bail application filed by the petitioner.

I have considered the submissions made on both sides and also perused the records available.

From the submissions made by the learned Government Advocate (Criminal Side) and the details placed before this Court, this Court is of the firm view that whenever the petitioner was enlarged on bail, he subverted justice and

thereby, became a menace to society. Therefore, while this Court is conscious to the liberty of the petitioner, the interest of the society must also be protected. Hence, considering the larger interest of the society, this Court is not inclined to enlarge the petitioner on bail.

Accordingly, this Criminal Original Petition is dismissed. 02-06-2026 VKR To 1.The Judicial Magistrate No.II, Udumalpet.
