Petition praying that in the circumstances stated therein the High Court will be pleased to relax the condition to appear before the learned Judicial Magistrate No.1, Namakkal on the first working day of every English Calendar Month at 10.30 am as per the order dated 29.08.2017 made in Crl.M.P.No.10795 of 2017 in Crl.R.C.No.1135 of 2017.
Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S.N.MANOKARAN, Advocate for the petitioner and of MR.R.SURIYAPRAKASH, GOVERNMENT ADVOCATE [CRL.SIDE] on behalf of the Respondent the court made the following order:- Seeking to relax the condition already imposed by this Court in Crl.M.P.No.10795 of 2015 in Crl.R.C.No.1135 of 2017, the petitioner is before this Court with this miscellaneous petition. 2.The learned counsel for the petitioner submitted that the petitioner is regularly complying with the conditions imposed by this Court and hence, the conditions may be relaxed.
3. The learned Government Advocate (Criminal Side) appearing for the State submitted that the petitioner is regularly complying with the earlier conditions imposed by this Court in Crl.M.P.No.10795 of 2015 in Crl.R.C.No.1135 of 2017 dated 29.08.2017.
4. In view of the above, the condition already imposed on the petitioner by this Court is modified to the effect that the petitioner shall appear before the Judicial Magistrate Court No.I,
Namakkal, once in three months i.e. first working day at 10.30 a.m. until further orders. This miscellaneous petition is ordered accordingly.
