Crl.O.P.No.14341 of 2023 G.CHANDRASEKHARAN.J., The petitioners namely Poobalan and Siva, who were arrested and remanded to judicial custody on 24.04.2023 for the offences punishable under Sections 302, 449 of IPC @ 147, 148, 120(b), 449, 342, 302, 429 of IPC in Crime No.211 of 2023 on the file of the respondent police seeks bail.
2. The learned counsel for the petitioners submitted that, petitioners are A4 & A5 in a case registered for the offences under Sections 302, 449 of IPC @ 147, 148, 120(b), 449, 342, 302, 429 of IPC in Crime No.211 of 2023. Petitioners are innocent persons and there is no specific overt act against them in the FIR. Petitioners are in Judicial Custody from 24.04.2023. Thus, he seeks bail to the petitioners.
3. In response, learned Government Advocate (Crl. Side) opposes the petition on the ground that, it is a case of three murders for gain. 1st accused is the foster mother of one Valarmathi. Accused Persons 1/3
with an intention to grab the properties committed the murder of Valarmathi and her children namely Manikandan aged about 10 years and Kesavan, who is 10 month old baby by slitting their neck.
4. Considered the rival submissions and perused the records. It is seen from the FIR allegations that the aforesaid deceased were murdered on 19.04.2023 in a house at Kattukottai. The deceased were murdered by slit opening their neck. Chilli powder were also thrown on their body.
5. Considering the nature and gravity of the offence, wherein a women aged about 35 years, and children aged about 10 years & 10 month old were murdered brutally and that investigation in this case is not completed, this Court is not inclined to grant bail to the petitioners.
6. Accordingly, this Criminal Original Petition is dismissed. 11.07.2023 Sma 2/3
