ORDER

The petitioner who was arrested and remanded to judicial custody on 26.12.2025 for the alleged offence under Sections 8(c) 20(b)(ii)(B) and 22(c),

29(1) of NDPS Act and 3(5) of BNSS in Crime No.292 of 2025 on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused person were in possession of 66.14 grams of Methamphetamine and 2.500 kgs of ganja for the purpose of same and the same had been seized by the respondent police. Hence, the case.

3. The learned counsel for the petitioner submits that there are totally four accused involved in this case and the recovery from this petitioner is only 29 grams of methamphetamine which is an intermediate quantity. He further submits that the petitioner is a college student and he is in judicial custody from 15.11.2025. Hence, prays to grant bail to the petitioner.

4. The learned Counsel for Government of Tamil Nadu (Crl Side) submitted that there are totally four accused in this case and from all the accused 2.5 kgs of ganja were recovered. He also submitted that the earlier bail petition filed by the petitioner in Crl.O.P.No. 6399 of 2026 was dismissed on 26.03.2026 Hence, he opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record.

Considering the facts of the case and he quantity involved in this case is commercial in nature and the petitioner failed to satisfy twin conditions under section 37 of NDPS Act, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition stands dismissed. 11-06-2026 Index: Yes/No Speaking/Non-speaking order SMN To.
