2. Initially, the schedule property was sold to one Dr.Meisin Yen and Dr.Y.Albert Leon Shie Kuang. Already, entire sale consideration of Rs.6,16,600 was paid by them to the Company in liquidation, however, sale deed yet to be executed. Subsequently, the said purchasers assigned the property in question in favour of the applicant by virtue of an assignment deed, dated 06.06.2022. Therefore, the applicant has filed this application seeking for a direction against the learned Official Liquidator to execute the sale deed to and in favour of the applicant.

3. The learned Official Liquidator has filed a report and stated that since the original purchasers assigned their rights to and in favour of the applicant and the entire sale consideration has also been paid, he has no objections for executing the sale deed in favour of the applicant. 1/2 https://www.mhc.tn.gov.in/judis

4. Mr.Zafrullah Khan, learned counsel appearing for Ex- Director of M/s. Alsa Constructions and Housing Ltd., also submitted that already the property was sold by the Company under liquidation, however, sale deed was not executed and they have no objections to execute the sale deed in favour of the applicant.

5. Considering the submissions made by learned counsel for the applicant and since no objection has bee reported by the learned Official Liquidator as well as on behalf of Ex-Director of the Company in liquidation, the learned Official Liquidator is directed to execute the sale deed to and in favour of the applicant after following due procedure. 09.06.2023 sd Comp.A.No.414 of 2022 in C.P.No.339 of 1999 2/2 https://www.mhc.tn.gov.in/judis
