ORDER

This Petition is filed seeking to modify the condition imposed by this Court in para No.5(vi) of Crl.M.P.No.21284 of 2025 in crl.R.C.No.2353 of 2025, dated 12.11.2025.

2. Learned counsel for the petitioner submitted that she has a minor girl child who is suffering from autism and she requires continuous and specialised speech Thereapy treatment. Having regard to the same, medical appointment has been scheduled for her child during first week of every month, during which time, the petitioner, who is the sole care giver for her child, has to accompany with her child for undergoing the said therapy. Hence, he prayed for modification of condition (vi) of paragraph 5 of the order dated 12.11.2025 to any other working day of the month until the disposal of the revision petition.

3. Mr.G. Anand Kumar, learned counsel for the respondent has no objection to the proposal made by the learned counsel for the petitioner.

4. In view of the above, this Court is inclined to modify the condition. Accordingly paragraph 5 (vi) of the order dated 12.11.2025 passed in Crl.R.C.No.2353 of 2025 is modified to the extent that the petitioner shall appear before the trial court on the 4th working day of every English Calendar month at 10.30 a.m., until disposal of the Criminal Revision Case. If the petitioner is not able to appear before the trial court on the day fixed by this Court, she shall make arrangement to file application under section 355 of BNSS Act and shall appear before the trial court on any other day as directed by the trial court.

4. Except the above modification, rest of the conditions of the order dated 12.11.2025 passed in Crl.R.C.No.2353 of 2025 shall remain unaltered.

5. With the above modification, this Criminal Miscellaneous Petition is disposed of.
