ORDER

The draft plaint is in respect of a mortgage suit relating to loans extended by the intending plaintiffs to defendants 1 to 3. Since __________ https://www.mhc.tn.gov.in/judis

defendants 3 to 5 reside or carry on business outside the jurisdiction of the Court, this application has been filed.

2. Both in the draft plaint and in the affidavit in support of this application, it is stated that the cause of action arose within the jurisdiction of this Court, wherein, loan was granted and monies were paid by the intending plaintiffs to defendants 1 to 3.

3. Upon considering the above, it appears that at least part of the action arose within the jurisdiction of this Court. Therefore, this application is allowed by granting leave to applicants to sue respondents 3 to 5 before this Court.

4. As a corollary, Registry is directed to number the suit if it is otherwise in order.
