Writ petitions under article 226 of the Constitutions of India praying that in these circumstances stated therein and in the respective affidavits filed their with the High Court will pleased to (i) Issue a writ, order or direction in the nature of a WRIT OF CERTIORARI, calling for the records relating to the proceedings of the 1st respondent in No.OSD/DE-1/ 29-13/SSP(C&I)/2017 dated 04.05.2017 and Charge Memo in No.OSD/DE-1/ 29-13/ SSP(C&I) 2017 dated 21.11.2017 quash the same in WP No.2714 of 2018 and; (ii)Stay of the impugned proceedings of the 1st Respondent in NO.OSD/DE-1/ 29-13/SSP(C&I)/2017 dated 04.05.2017 and Charge Memo in No.OSD/DE-1/ 29-13/ SSP(C&I) 2017 dated 21.11.2017 (IN WMP.NO.3358 OF 2018)pending disposal of the above in WP No.2714 of 2018 respectively.
Order : These petitions coming on for orders upon perusing the petition and the affidavits filed in support thereof and upon hearing the arguments of M/S.S.RAVEEKUMAR, Advocate for the petitioner and of MR.J.KUMARAN, GOVERNMENT ADVOCATE (PONDY) on behalf of the 1 & 2 Respondents the court made the following order:- https://hcservices.ecourts.gov.in/hcservices/
The impugned order is passed with reference to the CCS (CCA) Rules, 1965. This apart, the impugned order of suspension has already been revoked. This writ petition is confined only with regard to the impugned charge memo, which was issued under the CCS (CCA) Rules.
2. In view of the fact that the Pondicherry matters are notified under the Administrative Tribunals Act, the petitioner has to adjudicate all the issues before the Central Administrative Tribunal, Chennai Bench.
3. Registry is directed to transfer all the case papers to the Central Administrative Tribunal, Chennai Bench for further adjudication.
