C.M.P.No.15749 of 2018 C.M.P.No.15749 of 2018 in S.A.No.267 of 2005 N.SESHASAYEE, J., The learned counsel for the petitioners/appellants submitted that due to inadvertence, as the counsel was engaged in another Court, there was no representation for the appellants and hence, the Second Appeal came to be dismissed for default on 11.07.2018. He further submitted that the appellants are ready to go ahead with the case even today.

3Having regard to the submissions made by the learned counsel for the petitioners/appellants and also having satisfied with the reasons stated in the affidavit filed in support of the petition, petition is allowed.
