Respondents Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the respondents to consider the petitioner's representation dated 23.3.2015, and to direct the respondents to cancel the expired sale agreement dated 27.9.2004, in respect of Survey No.175/2 in Vedappattu Village measuring to an extent of 0.47.5 hectares. By consent, the writ petition itself is taken up for final disposal.
2.According to the petitioner, his mother viz. Periyathai, wife of Samanna Gounder, is the owner of the property admeasuring to an extent of 0.47.5 hectares in Vedappattu Village in Survey No.175/2 and she entered into an agreement of sale with one Pandurangan on 27.9.2004, and the period of performance of the agreement was fixed till 26.9.2005. However, the said person did not take any steps for execution of the sale deed and subsequently, the mother of the petitioner has executed a deed of settlement dated 23.7.2010, in favour of the petitioner. The petitioner made verification with https://hcservices.ecourts.gov.in/hcservices/
regard to the encumbrance of the said property and he found that there is a mention about the above said registered agreement and for removal of the said encumbrance, he submitted a representation dated 23.3.2015, to the second respondent and though it was acknowledged, the second respondent did not take any action and hence, he came forward to file this writ petition.
3.Heard the submissions of the learned Counsel appearing for the petitioner, and Mr.M.Digvijaya Pandian, learned Additional Government Pleader, who accepts notice for the respondents. 4.This Court, taking into consideration, the limited scope of prayer sought for by the petitioner, and without going into the merits of the representation, directs the second respondent to consider and dispose of the representation of the petitioner dated 23.3.2015, strictly in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order and communicate the decision to the petitioner. The writ petition accordingly, stands disposed of. No costs.
