PRAYER: Writ Petition filed under Article 226 of the Constitution of India, pleased to issue a Writ of Certiorari or any other appropriate Writ, direction or order, calling for the records relating to the award passed by the 1 st respondent made in A./3492/2010 dated 20.06.2011 and quash the same. ORDER
When the matter came up for hearing the learned counsel for the petitioner submits that even though the petitioner claimed for conferment of permanent status and got an award, they are not in employment and they have never even reported for employment neither they have come before this Court. Even the notices in the original address is not served and they are unheard of and service is completed only through substituted service.
2.In that view of the matter, the adjudication is necessary, if only the employees come to the Board, seeking for implementation of the order, since at 2/5
present the said cause is not there, the learned counsel seeks withdrawal of the Writ Petition with liberty to file a Writ Petition on the very same cause of action challenging the very same order, in case the employees report before the petitioner and seek for implementation of the order or work. With the said liberty as prayed for by the learned counsel, the Writ Petition is dismissed as withdrawn.
