ORDER

The petitioner, who was arrested and remanded to judicial custody on 01.05.2026 for the alleged offence under Sections 191(2), 191(3), 296(b), 115(2), 118(1), 103(1) of BNS in Crime No.41 of 2026 on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner, along with other accused, in an inebriated condition, demanded money from the de facto complainant for having worked during the election and indulged in a wordy quarrel. During the course of quarrel, the petitioner assaulted the de facto complainant by hurling a stone at him. Though the de facto complainant managed to escape, the stone hit one Gajendran, who had accompanied the de facto complainant, causing severe injuries. Subsequently, the said Gajendran succumbed to the injuries sustained by him. Hence, the case. 3.

There is no representation for the petitioner either in person or through counsel.

The learned Government Advocate (Crl.Side) appearing for the respondent vehemently opposed for grant of bail to the petitioner on the ground that the petitioner is a history sheeter and he has got 4 previous case. 5.

I have considered the submissions made on both sides and also perused the records available.

Considering the fact that petitioner is a history sheeter, and that there are five previous cases, this Court is of the view that the petitioner is not entitled for bail.
