PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents to pay the pending amount of difference of Gratuity of Rs.50,137/-, difference of Leave Liability of Rs.1,521/- and Retirement Benefit Scheme amount of Rs.16,200/- to the petitioner as communicated in letter No.1066711095(346)/PI0/TNSTC(V)/2023, dated 17.05.2023 under Right to Information Act 2005 along with interest at the rate of not less than 12% per annum payable from the date of retirement within the time limit as stipulated by this Court.

ORDER

Heard Mr.N.Ishak, learned counsel for the petitioner and Mr.R.Venkatesha Perumal, learned Standing Counsel for the respondents.

2. The petitioner had retired from service from the respondent Corporation on 31.01.2017. On 15.04.2023, the petitioner sought for information under Right to Information Act, 2005 about the pending dues consequent to pay revision from 01.09.2019. On 17.05.2023, the respondents communicated reply for the queries under RTI Act, 2005 that Rs.50,137/- as difference of Gratuity, Rs.1,521/- as difference of Leave Liability and Rs.16,200/- as Retirement Benefit Fund are pending for payment to the petitioner.

3. In view of the admitted fact that the petitioner is eligible for the amount, which has not been paid till date, the petitioner would be entitled for interest on the outstanding amount.

4. In the light of the above observations, the respondents are directed 2/4

to pay the petitioner the terminal benefits, together with interest at the rate of 4% from the date on which he would be eligible for such payment, till the date of actual disbursement, within a period of four weeks from the date of receipt of a copy of this order.
