The petitioner who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 273, 328 of IPC r/w Section 20(2) of Cigarette and other Tobacco Products Acts, 2003, in Crime No.107 of 2022, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner and other accused were found in possession of 1425 packets of Hans. Hence, the complaint.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and no way connected with the alleged offence and he has been falsely implicated in this case. Hence, he prays to grant anticipatory bail to the petitioner.

4. The learned Additional Public Prosecutor submits that there are totally 2 accused in which the petitioner is arrayed as A2. The petitioner and other accused were in conscious possession of 1425 packets of Hans and the petitioner is having four previous cases similar in nature. 5. Taking into consideration the facts and circumstances of the case and the bad antecedent of the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
