Writ Petition is filed under Article 226 of the Constitution of India, praying for the issuance of a Writ of Certiorari, calling for the records of the second respondent's Tender Specification No.CE/NCTPS-121/2014-2015 and quash the same.

O R D E R

The Tender Specification Abstract issued by the respondents, is under challenge in the present writ petition.

2. The scope of tender is to supply and renewal of wornout Tongue Rails, Crossings and CST-9 Sleepers in AIP and NCTPS Railway Siding Track.

3. It was an open Tender called for and Tender Specification abstract is under challenge in the present writ petition.

4. The Tender was proceeded with and the specification mentioned by the respondents is prerogative of the Railways and the required specification mentioned in the year 2014 deserves no merit adjudication at this length of time.

5. This apart, the Specification, which was challenged in the year 2014 lost its relevance, as the process of Tender concluded and the cause aroused for the purpose of filing the present writ petition lost its relevance. Thus, no further adjudication needs to be entertained in respect of the grounds raised in the present writ petition and consequently, the writ petition stands closed. However, there shall be no order as to costs. Consequently, connected miscellaneous petitions are also closed.
