ORDER
The petitioner is an accused in Spl.C.C. No.192 of 2025 on the file of the Special Court for EC/NDPS Act cases, Salem. The petitioner was arrested and remanded to judicial custody on 17.04.2025 for the alleged offence under Sections 8(c) r/w 20(b)(ii)( c), 29(1) of NDPS Act, 1985 in Crime No.14 of 2025 on the file of the respondent police, seeks bail.

The case of the prosecution is that on 24.02.2025 at about 11.00 hrs when the Special sub Inspector of Police was in a station duty, he received secret information about illegal sale of narcotic substances. Immediately, the Special Sub Inspector of Police along with his police parties went to the scene of occurrence, at that time, two unknown persons standing in that place in a suspicious manner and on seeing the police, they attempted to escape from that place, however the police caught hold them and on search, they found that the accused were found in possession of 43 kgs of ganja. Hence, this case.
3. The learned counsel appearing for the petitioners submitted that the petitioner is a innocent person and he has been falsely implicated in this case. He further submitted that only based on the confession statement given by A2 the petitioner/A1 was arrested. However, there is no evidence to connect the petitioner in this case. Hence, he prays to grant bail to the petitioner.
4. The learned Counsel for Government of Tamil Nadu (Crl Side) has filed a counter wherein it has been stated that totally there are 3 accused in this case. In the counter it has been further stated that as per Call Detail Record there was telephonic transaction between the three accused persons. It is also stated that A1 has sent a sum of Rs. 90,000/- through online payment to bank Account
No.17890100010862 Federal Bank Palladam Branch. Further A3 has also sent money to the said bank account on 23.02.2025 and the bank account is freezed on 26.08.2025. Hence, he vehemently opposed for grant of bail to the petitioner.
5. Heard both sides and perused the materials available on record.
6. Consider the facts of the case and the quantity involved in this case and there was money transactions between the petitioner and the other accused persons and the earlier bail petition was dismissed by this Court in Crl.O.P.No.32537 of 2025 on 27.11.2025 and this is the second bail petition, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition stands dismissed.
