ORDER

The petitioner is an accused in CC.No.990 of 2024 pending before the Principal Special Judge for the E.C. and NDPS Act in Chennai. The petitioner was arrested and remanded to judicial custody on 30.07.2024 for the alleged offence under Sections 8(c), 20(b)(ii)(B) and 29(1) of NDPS Act, 1985 as wells

as Section 22(c) of the same Act in Crime No.694 of 2024 on the file of the respondent police.

2. The case of the prosecution is that based on the confession statement of the petitioner he was arrested on P.T warrant in Crime No.694 of 2024 and he confessesion that he was in possession of 60 grams of Methamphetamine. Hence, this case.

The learned counsel appearing for the petitioners submitted that the confession statement of the petitioner reveals that the Kattur Police filed a case against the petitioner and two other in Crime No. 621 of 2023 under Section 22(c) and 8(c) of the NDPS Act which resulted in their arrest for having 10 grams of Methamphetamine. Subsequently the petitioner was arrested in Crime No.694 of 2024 on the file of the respondent police. Furthermore in the confessions statement the petitioner has indicated that he had kept the contraband property in a secret location for a year before making this confession. Hence, he prays to grant bail to the petitioner.

The learned Counsel for Government of Tamil Nadu (Crl Side) would submit that the total quantity involved in this case 60 grams of Methamphetamine and 2 kilograms of ganja and after complying all the mandatory provisions, the seizure was effected ,the statement of the petitioner and witnesses were recorded, the seizure mahazar was prepared and the

petitioner was produced before the learned Magistrate along with the seized contraband and remanded to judicial custody and the contraband involved in this case is a commercial quantity. He further submitted that there are 15 previous cases pending against the petitioner and vehemently opposed for grant of bail to the petitioner.

5. Heard both sides and perused the materials available on record.

6. Considering the facts of the case, this Court is of the view that the grounds raised by the petitioner can be decided only at the time of Trial and not in this petition. Taking note of the facts of the case and the quantity involved in this case is commercial in nature and the petitioner failed to satisfy twin conditions under section 37 of NDPS Act and this is the third bail petition and the earlier bail petitions filed by the petitioner in Crl.O.P.No.16864 of 2025 and Crl.O.P.No.5962 of 2025 was dismissed by this Court on 25.02.2026 and 12.03.2026 respectively. Hence, this Court is not inclined to grant bail to the petitioner and this Criminal Original Petition stands dismissed. However, the Trial Court is directed to complete the Trial within a period of nine months from the date of receipt of a copy of this order.
