Criminal Original Petition filed under Section 482 of the Code of Criminal Procedure, to issue a direction to the respondents to consider the representation of the petitioner dated 27.08.2021 and to transfer the investigation of the case in Crime No.753 of 2021 on the file of respondent No.2 to CBCID investigation.

ORDER

This petition has been filed to issue a direction to the respondents to consider the representation of the petitioner dated 27.08.2021 and to transfer the investigation of the case in Crime No.753 of 2021 on the file of the second respondent to CBCID investigation.

2. The contention of the petitioner is that the respondent Police have not taken any proper action and no investigation has been conducted. Hence, this petition is filed. https://hcservices.ecourts.gov.in/hcservices/

3. The learned Additional Public Prosecutor has submitted that in this case, the date of occurrence is 15.07.2021 and the First Information Report was registered on 17.07.2021. After investigation, the case has been altered for the offence under Sections 304(2) and 201 IPC r/w 135 (1) (a) of the Electricity Act. In this case, two persons were arrayed as accused as A1 and A2 and they were arrested on 18.07.2021.

4. This Court, on perusal of the alteration report and the submissions made by either parties came to the conclusion that investigation is under progress.

5. In view of the same, the respondent Police is directed to continue the investigation and file a final report within a stipulated time, without any delay.

6. With the above direction, this Criminal Original Petition is disposed of.
