The application has been filed seeking to appoint an Advocate Commissioner to record the evidence of the attesting witness of N.Karruppaiah as PW2, who is residing at No. 7, Srirangapuram, South Street, Devakkottai - 630302, Sivagangai District.

2. In the affidavit filed in support of the judge's summons, it had been stated that the said witness is unable to walk and is bed ridden and therefore, the Advocate Commissioner is required to record his evidence.

3. However, the learned counsel for the respondent stated that he could also appear through video conferencing and the evidence could be recorded through video conferencing. The video conferencing rules of the High Court have already been put in place.

4. List the matter before the learned Master on 06.08.2024 and depending on the convenience of the Court and the parties, the learned Master may record the evidence of the proposed witness as PW2 either on that date or any other date. After recording of the evidence, the matter may be listed before this Court. The application stands allowed. 23.07.2024 Maya
