Palpandi v. The Inspector Of Police

The petitioner, who apprehends arrest at the hands of the respondent police for the alleged offences punishable under Sections 6(4) of the Tamil Nadu Schedule Commodities (RDCS) Order 1982 r/w. Section 7(1)(a)(ii) of Essential Commodities Act 1955 in Crime No.133 of 2023, seeks anticipatory bail.

2. The case of the prosecution is that the petitioner, along with other accused, was found in illegal transportation of 1020 kgs of PDS rice. Hence, the complaint.

3. The learned counsel appearing for the petitioner would submit that the petitioner is innocent person and he has been falsely implicated in this case and he has no way connected with the alleged offence. Hence, he prays for grant of anticipatory bail to the petitioners.

4. The learned Government Advocate (Crl.Side) submitted that the petitioner, along with other accused, was found in illegal transportation of 1020 Kgs of PDS rice. He further submitted that there are seven previous cases pending against the petitioner, similar in nature. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.

5. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) and perused the materials available on record including the FIR.

6.Taking note of the facts and circumstances of the case and the submissions made by the learned counsel on either side and also taking note of the fact that there are seven previous cases pending against the petitioner, hence, this Court is not inclined to grant anticipatory bail to the petitioner.

7. Accordingly, the Criminal Original Petition stands dismissed.
