Mr.T.N.C.Kaushik Additional Government Pleader (T) in both petitions COMMON ORDER By these writ petitions, assessment orders relating to two assessment periods are challenged primarily on the ground of breach of principles of natural justice.

2.Mr.T.N.C.Kaushik, learned Additional Government Pleader, accepts

notice for the respondent.

3.Upon perusal of the orders impugned herein, it evident that the petitioner was not heard and that the tax proposal was confirmed for such reason. Therefore, subject to putting the petitioner on terms, the impugned orders are liable to be interfered with.

4.Accordingly, subject to the petitioner remitting 10% of the amount demanded under the impugned orders within two weeks from the date of receipt of a copy of this order, the impugned orders are set aside and the matters are remanded for reconsideration. After providing a reasonable opportunity to the petitioner, a fresh order shall be issued within three months from the date of receipt of a copy of this order. 5.These Writ Petitions are disposed of.
