ORDER

By this writ petition, the petitioner seeks a direction to the 2nd respondent for the expeditious disposal of Opposition No.1350081 and Trade Mark Application No.5982440 in relation to the trade mark "MANJAL RESTAURANT".

2. In paragraph 24 of the affidavit in support of the writ petition, the petitioner has set out details of the prosecution of the above mentioned trade mark application, including the opposition relating thereto. He further submits that no hearing has been scheduled for more than six months.

3. In response, learned counsel for the 1st respondent states that the 2/4

said respondent has no objection to the expeditious disposal of the opposition and trade mark applications. He, however, reserves his right to raise all contentions in the said proceedings.

4. In these circumstances, without expressing any opinion on the merits of the matter, the writ petition is allowed by directing the 2nd respondent to dispose of Opposition No.1350081 and Trade Mark Application No.5982440 in respect of the trade mark "MANJAL RESTAURANT" within three months from the date of receipt of a copy of this order.
