Today, the matter is listed under the caption "for being mentioned" at the instance of the learned counsel for the petitioners.

The learned counsel for the petitioners submitted that even though this Court by an order dated 29.03.2021, directed the trial Court to decree the suit on receipt of the Joint Memo of Compromise dated 29.03.2021, the same was not decreed. He further submitted that the second respondent herein was set exparte and now she died. Hence, he prays to clarify the above order and issue suitable direction. 3.
Considering the above submission, the paragraph No.4 of the order dated 29.03.2021 passed in C.R.P.(PD)No.4144 of 2014 & C.R.P.(PD)No.3458 of 2019, shall read as follows :- "4. In view of the joint compromise memo, the petitioners and respondents are directed to appear before the trial Court and produce a copy of the joint compromise memo dated 29.03.2021 before the Court below on or before
23.12.2022. On receipt of the joint compromise memo, the trial Court viz., the learned III Additional District Judge, Thiruvallur, Poonamallee, is directed to pass decree in accordance with the joint compromise memo dated 29.03.2021 filed by the parties, within a period of two weeks thereafter. It is further clarified that the first defendant/second respondent was already set ex-parte and she also died now. If at all there is any grievance over the suit property, the legal heirs of the deceased first defendant/second respondent are at liberty to agitate before the Trial Court in respect of the suit property, if so advised."

Registry is directed to replace the above paragraph in the order dated 29.03.2021 in CRP.PD No.4144 of 2014 and CRP.PD.No.3458 of 2019 and issue a fresh order copy. 09.12.2022 mn Note : Issue order copy today on or before 12.12.2022
