Respondents Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of Writ of Mandamus, directing the respondents 2 and 3 to consider and pass orders on the petitioner's representation, dated 28.04.2025 seeking to remove the encumbrance over the petitioner's property comprised in S. No.295/3 having an extent of 80 cents and S. No.327/5 having an extent of 30 cents totally having an extent of 1.30 acres of land situated in Kolathur Village, Chengalpet District.

O R D E R

Mr. R. Sasikumar, learned Government Advocate accepts notice for the respondents 1 to 3.

2. By consent of learned counsel on both sides, this writ petition is taken up for final hearing in the admission stage itself.

3. It is averred that on 14.09.1993, the petitioner had purchased the agricultural lands under registered Sale Deed and she is in peaceful possession and enjoyment of the same. The patta, chitta, adangal and A-Register were issued in the name of the petitioner. Shockingly, it was noticed, while applying for Encumbrance Certificate that there were two encumbrances reflected in respect of her property. Hence, she submitted a complaint to the 1st respondent on 28.04.2025 seeking for removal of encumbrance over the petitioner's property and the same was forwarded to the respondents 2 and 3 for appropriate action. However, till date, no action was taken by the official respondents. Therefore, the petitioner has approached this Court seeking for issuance of the relief of Mandamus to the respondents 2 and 3.

4. Learned counsel for the petitioner submits that it would suffice if a direction is issued by this Court to the respondents 2 and 3 to consider the petitioner's compliant / representation, dated 28.04.2025 on merits and in accordance with law, within a time frame to be fixed by this Court.

5. Learned Government Advocate appearing for the respondents 1 2/4

to 3 has no objection for issuance of appropriate directions by this Court in the above regard.

6. Considering the submissions made by the learned counsels on both sides, this Court without going into the merits of the case, directs the respondents 2 and 3 to consider the petitioner's compliant / representation, dated 28.04.2025 on merits and in accordance with law, after giving due opportunity to all the parties, including the private respondents, within a period of eight weeks from the date of receipt of a copy of this order.

7. With the above directions, this writ petition is disposed of. No costs.
