This Court while disposing Crl.O.P.No.16786 of 2021 by order dated 04.08.2022, had directed the third respondent to complete the investigation in Crime No.979 of 2020 and file the final report within a period of three months from the date of the receipt of a copy of the order.

When the matter was listed on 07.11.2024, it was represented by the learned Government Advocate (Crl.Side) that the investigation has been completed and the final report has been filed through e-filing before the Special Court for CCB & CBCID cases, Egmore on 19.04.2024. This Court directed the Investigating Officer to file an affidavit with regard to the same and he was also directed to get instructions with regard to the status of the final report filed through e-filing.

3. Today, when the matter is taken up for hearing, an affidavit has been filed by Mr.R.K.Sasidhar, Deputy Superintended of Police, CBCID Metro 1, Egmore, Chennai. The affidavit is taken on record. 1/4

Learned Government Advocate (Crl.Side) appearing for the respondents would submit that the final report has been filed through e-filing as early as on 19.04.2024 in filing No.LTN20230002735C202400004. He would further submit that on 21.07.2023, a request has been submitted before the Hon'ble Special Court under EC & NDPS Act, Chennai to transfer the mother case FIR and the other material documents in K2 Ayanavaram P.S Cr.979 of 2020, to the Special Court for Exclusive Trial of CCB & CBCID, Metro cases at Egmore, Chennai. But the Investigating Officer understands that the documents have not been received so far.

Taking note of the fact that the final report has been filed on 19.04.2024 through e-filing. A direction is issued to the learned Special Judge for Exclusive Trial of CCB & CBCID, Metro cases at Egmore, Chennai, to take the final report and complete the formalities and commit the case to the Court of Sessions as expeditiously as possible, from the date of receipt of a copy of this order.
