ORDER
The petitioner/Accused No.2, who was arrested and remanded to judicial custody on 04.01.2026 for the offences punishable under Section 'Woman missing' altered to Sections 103(1) and 238 of B.N.S. Act in Cr. No.1 of 2026 on the file of the respondent police, seeks bail.
2. The case of the prosecution is that A1 is mother of the defacto complainant and mother-in-law of the deceased Nandhini. The petitioner herein, who is A2, is the friend of A1. The defacto complainant married the said Nandhini, who is a widow having a daughter through her 1st marriage, due to which, there was a dispute between A1 and the defacto complainant. While so, A1 accompanied by the petitioner / A2 herein, took the deceased Nandhini to Manimuthu River, under the guise of doing pooja and cut her throat using knife and intentionally committed murder. Hence the case.
3. The learned counsel for the petitioner would contend that the respondent police have registered a false case against this petitioner, that this petitioner is arrayed as A2 in this case and she is nothing to do with the commission of murder, that in fact there was a family dispute between the deceased and the accused 1 and 2 and that this petitioner has not committed any offence as alleged in the FIR. The learned counsel would further submit that the petitioner has been under incarceration since 04.01.2026 and hence he prayed to enlarge the petitioner on bail.
4. The learned Government Advocate (Criminal Side) would submit that this petitioner had accompanied A1 and had intentionally committed murder of the deceased and investigation is not completed. He would further submit that the offences are grave in nature and hence he strongly objected to grant bail to the petitioner.
5. Heard both sides and perused the materials available on record.
6. Considering the rival submissions on either side, considering the fact that investigation is not yet completed and the gravity of offences, this Court is declined to grant bail to the petitioner at this stage.
7. Accordingly, this Criminal Original Petition is dismissed. 13-05-2026 MJS Note:
