WMP No.19764 of 2019 in WP No.8729 of 2019 S.MANIKUMAR, J., AND SUBRAMONIUM PRASAD, J., [Order of the Court was made by S.MANIKUMAR, J.] While dismissing WP No.8729 of 2019 vide order dated 28.03.2019, we directed payment of costs of Rs.10,000/-[Rupees Ten Thousand Only], to be paid by the petitioner to the account of Juvenile Justice Fund, Director of Social Defence, Ministry of Social Welfare, Government of Tamilnadu, Kellys, Kilpauk, Chennai-600 010, within a period of ten days from the date of receipt of a copy of the order, failing which, the District Collector, Erode District, was directed to take action for recovery, under the Tamil Nadu Revenue Recovery Act, 1864.
2. Costs as directed, has not been paid. Hence, the Block Development Officer, Modakurichi Panchayat Union, Modakurichi, Erode District, has issued a Memo in RC No.924/2019/B2 dated 01.07.2019, directing the petitioner to pay Rs.10,000/- within 10 days to the account of Juvenile Justice Fund, Director of Social Defence, Ministry of Social Welfare, Government of Tamilnadu, Kellys, Kilpauk, Chennai-600 010.
3. Contending inter alia that copy of the order made in WP No.8729 of 2019 dated 28.03.2019 was received only on 04.06.2019 and that the
petitioner did not have money to pay the costs in time and in that process time granted had already expired, petitioner has filed WMP No.19764 of 2019 in WP No.8729 of 2019 praying to extend the time by two weeks for payment of costs. However, Mr.C.S.Saravanan, learned counsel for the petitioner submitted that costs will be paid within one week from today.
4. Placing on record the above submission, time is extended by one week from today, to pay costs of Rs.10,000/- [Rupees Ten Thousand Only], to the account of Juvenile Justice Fund, Director of Social Defence, Ministry of Social Welfare, Government of Tamilnadu, Kellys, Kilpauk, Chennai-600 010. It is made clear that failure to pay costs in time, as assured by the petitioner, would entail action under the Tamil Nadu Revenue Recovery Act, 1864.
